By using the petitecokids.com web site (“petitecokids“ or the “Site”), you (the ‘buyer’, ‘user’ or ‘you”) agree to be bound by the following terms and conditions (the “Terms of Use” or the “Agreement“).

·      Petitecokids acts as a venue to allow users who comply with Petitecokids’s policies to browse certain goods for sale online. No sales transactions or exchange of funds occur through Petitecokids; all sales are handled through third-party commerce sites. Petitecokids is not directly involved in the transaction between buyers and sellers. Therefore, Petitecokids has no control over the quality, safety, morality or legality of any aspect of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to pay for items. Petitecokids cannot ensure that a buyer or seller will actually complete a transaction.

·      Consequently, Petitecokids does not transfer legal ownership of items from the seller to the buyer. Petitecokids cannot guarantee the true identity, age, and nationality of a user.

·      The buyer will be redirected to third-party sites to complete transactions to purchase items showcased on Petitecokids. The buyer is responsible for compliance with that third-party's terms and policies. The buyer may be expected to create an account on the third party site to complete a transaction. Petitecokids claims no affiliation with these sites, and cannot be held responsible for content found therein. It is the buyer’s responsibility to read and understand all policies on third-party sites that the user is referred to through Petitecokids.

·      The buyer agrees that Petitecokids, as a venue, is not responsible or liable for user-generated content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video or items. Petitecokids does not pre-screen the content or information provided by users beyond an initial application to gain a showcase space. The buyer may be exposed to material that may find offensive or objectionable. All users take advantage of Petitecokids service at their own risk.

·      Protecting the privacy of the very young is especially important, therefore no part of our website is structured to attract anyone under 13.  If you are under 13, you may use Petitecokids only with the involvement of a parent or guardian.

·      Petitecokids may show prices in other currencies than the one you have entered according to correspondent exchange rates.

Membership

In order to register as a member on Petitecokids, you need to submit your Name, Surname, Email and Password by filling out Petitecokids’s registration form. Petitecokids’s membership is free and all the collected information through registration will be used according to our Privacy Policy.

Conditions

Petitecokids reserves the right to modify or terminate the Petitecokids Membership for any reason, without notice, at any time. Petitecokids reserves the right to alter the Terms of Use or other Site policies at any time. If the alterations constitute a material change to the Terms of Use, Petitecokids will notify you via email to the email address in your account. What constitutes a "material change" will be determined at Petitecokids's sole discretion, in good faith, and using common sense and reasonable judgment.

Notices

Except as explicitly stated otherwise, any notices shall be given by email to Petitecokids (in the case of Petitecokids); or, to the email address you provide to Petitecokids (either during the registration process or when your email address changes). Notice shall be deemed given 72 hours after email is sent, unless the sending party is notified that the email address is invalid.

Content

It is possible to publish Petitecokids content for an outside website or a third party to re-post that content while you agree to hold Petitecokids harmless for any dispute concerning this use. If you choose to display your own Petitecokids-hosted image on another website, the image must provide a link back to its listing page on Petitecokids.

No guarantee

Petitecokids does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Petitecokids’s control.

Intellectual Property

Petitecokids and Petitecokids's graphics, logos, designs and service names are trademarks or trade dress ofPetitecokids. Petitecokids's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion.

Information Control

Petitecokids does not control the content provided by stores or users that is made available on Petitecokids. You may find some content to be offensive, harmful, inaccurate, or deceptive. There are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using Petitecokids, you agree to accept such risks and that Petitecokids is not responsible for any and all acts or omissions of users on Petitecokids.

Petitecokids is not responsible for the availability of outside websites or resources linked to or referenced by the Site. Petitecokids does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that Petitecokids shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.

No warranty

Petitecokids (Petitecokids's parent, subsidiaries, officers, directors, employees and suppliers) provide Petitecokids's web site and services "as is" and without any warranty or condition, express, implied or statutory. Petitecokids (Petitecokids's parent, subsidiaries, officers, directors, employees and suppliers) specifically disclaim any implied warranties of title, merchantability, performance, fitness for a particular purpose and non-infringement. In addition, no advice or information (oral or written) obtained by you from Petitecokids shall create any warranty. Some countries do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.

Resolution of disputes

In the event that a dispute arises between you and Petitecokids, pleasecontact Petitecokids immediately.

Release

Should you have a dispute with one or more users, or an outside party, you release Petitecokids (and Petitecokids's officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Furthermore, you agree to release Petitecokids (and Petitecokids' affiliates, officers, directors, agents, subsidiaries, joint venture partners and employees) from any and all liability and obligations whatsoever in connection with, or arising from, your use of Petitecokids. If at any time you are not happy with the Website or the services provided there through or object to any content, your sole remedy is to cease using the site.

Breach

Without limiting any other remedies, Petitecokids may, without notice, and without immediately remove content, temporarily or indefinitely suspend a member’s account privileges, terminate a member’s account or take technical and legal steps to keep a user off the site and refuse to provide services to a user if any of the following apply:

Petitecokids suspects (by information, investigation, conviction, settlement, insurance or escrow investigation, or otherwise) a user has breached this Agreement, the Privacy Policy, or other policy documents incorporated herein; Petitecokids is unable to verify or authenticate any of your personal information or content; Or Petitecokids believes that a user is acting inconsistently with the letter or spirit of Petitecokids’s policies, has engaged in improper or fraudulent activity in connection with Petitecokids or the user's actions may cause legal liability or financial loss to Petitecokids's users or to Petitecokids.

Liability limit

In no event shall Petitecokids, and (as applicable) Petitecokids's parent, subsidiaries, officers, directors, employees or suppliers be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the use of the site, Petitecokids’s services, or this agreement, including without limitation, lost profits, bodily injury, emotional distress, or any special, incidental or consequential damages.

Some countries do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnity

You agree to indemnify and hold Petitecokids (and as applicable, Petitecokids's parent, subsidiaries, affiliates, officers, directors, agents, and employees) harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

Legal compliance

You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of Petitecokids’ service.

Severability

If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.

This Agreement is effective upon your first use of the Website.
